    ISLAMABAD:

    Interior Minister Rana Sanaullah on Wednesday alleged that Supreme Court judges Ijazul Ahsan and Mazahar Ali Akbar Naqvi were biased against the Pakistan Muslim League-Nawaz (PML-N).

    In a statement, the PML-N senior leader said that Justice Ahsan was the supervising judge in the case against party supremo Nawaz Sharif and \”justice was not expected from him\”.

    He also questioned the impartiality of Justice Naqvi, claiming that irrefutable evidence had emerged in the audio leaks case that the judge was hearing.

    Justice Naqvi is heading the bench in the case of misconduct in the Supreme Judicial Council (SJC) against an apex court judge after audio leaks emerged purportedly featuring a conversation about the fixation of the case before a particular bench or judge with former Punjab chief minister Pervaiz Elahi.

    \”It has become a tradition in law and judiciary that controversial judges voluntarily recuse themselves from hearing the relevant case,\” he said.

    The home minister added that there is also a tradition of removing controversial judges from a bench at the request of the aggrieved party.

    Sana maintained that the PML-N legal team will ask the two judges to withdraw from the benches hearing the cases of Nawaz Sharif and other party leaders.

  • Loan talks revived after govt bows to IMF diktat | The Express Tribune


    ISLAMABAD:

    In a major development, the International Monetary Fund (IMF) on Thursday announced sending its mission to Pakistan next week in a bid to break a deadlock over critical conditions regarding plugging a fiscal hole of around Rs2.5 trillion through a combination of taxation, expenditure and power tariff measures.

    “At the request of the (Pakistani) authorities, an in-person fund mission is scheduled to visit Islamabad from January 31 to February 9 to continue discussions under the 9th EFF (Extended Fund Facility) Review,” Esther Perez, the Resident Representative of the IMF said.

    The much-delayed announcement came hours after Finance Minister Ishaq Dar bowed to let the rupee devalue by Rs25 to a dollar or 9.61% – the highest ever drop in a single day in Pakistan’s history.

    The government moved only after the US conveyed in plain words to the government to follow the IMF path instead of seeking political favours while foreign nations, too, excused themselves from giving more lifelines without the IMF umbrella.

    “The US sent its deputy assistant treasury secretary to Pakistan to deliver the message,” according to a government source.

    Prime Minister Shehbaz Sharif also met with US Ambassador Donald Blome, informing him about Pakistan’s decision to take the IMF route. But Pakistan still asked for some relaxation in the IMF conditions, finding the conditions impractical in the present charged political atmosphere.

    The Pakistani rupee plunged to a record low of Rs255.43 against the dollar in the interbank market on Thursday, sliding nearly Rs25 or 9.61% from a day.

    After taking the oath as the finance minister, Ishaq Dar had vowed to bring back the dollar price to Rs180 from around Rs240. On October 11, the rupee-dollar parity touched to around Rs217 but from there it started recovering.

    Before the IMF announcement, Pakistani team, led by Dr Aisha Pasha, Minister of State for Finance, shared a draft framework to implement some of these actions over next few days.

    Even if both the sides are able to reach a consensus by February 9 and Pakistan delivers on the promises, the next tranche may not come before the end of March.

    The IMF on Thursday laid bare its demands from Pakistan, which are in line with the agreement signed between both sides. “The mission will focus on the policies to restore domestic and external sustainability, including to strengthen the fiscal position with durable and high quality measures while supporting the vulnerable and those affected by the floods,” said Perez.

    The sources said that the government’s assessment was that as against the old commitment to provide primary budget surplus of 0.2% of GDP, there is now a gap of 2.8% of the GDP or Rs2.5 trillion against the budgeted targets. “But the IMF’s assessment was that the gap was about Rs3.2 trillion or 3.6% of GDP,” said the sources.

    The IMF was ready to relax the condition to the extent of expenditure on floods, which may slightly shrink the size of the hole. During 10-day long talks, both the sides would try to find a middle ground. “So far, the IMF has shown no inflexibility,” said the sources.

    The IMF has told Pakistan to bring a mini-budget, comprising measures that will ensure quick and clean recovery of taxes to avoid the courts’ path. These measures will include increase in the petroleum levy rate on petroleum products, taxes on tobacco, sugary drinks and taxes on commercial banks.

    The IMF has not agreed to the FBR’s proposal to impose new taxes worth Rs170 billion only, as its demand is much more than this. The fund has estimated Rs420 billion shortfall against the FBR’s annual target of Rs7.470 trillion.

    Esther further said that the IMF mission will also focus on “restoring the viability of the power sector and reverse the continued accumulation of circular debt”.

    The sources said that after the record single-day exchange rate devolution, this will be the hardest nut to crack with the IMF. According to the Power Division’s own assessment, there was about Rs805 billion deviation against the annual reduction plan.

    This will require minimum Rs7.50 per unit increase in tariffs, or even may be more depending upon what base the government takes, according to the sources. If the government takes the lifeline consumers limit of 200 units monthly consumption, then the increase will be more and if the IMF allows to relax the limit to 300 unit, then the increase will be less.

    The deviation in the plan was mainly because of political decisions by Prime Minister Shehbaz Sharif to give subsidies to exporters, waive fuel cost adjustments and poor governance of the Power Division.

    Import Controls

    The IMF’s Resident Representative stated that the Mission will focus on “reestablishing the proper functioning of the foreign exchange market, allowing the exchange rate to clear the FX shortage”.

    The statement suggested that Pakistan will have to lift all restrictions on the imports that led to reduction in the monthly import bill from $7.5 billion to the $5.3 billion on an average. The lifting of restrictions will father drive the value of the US currency very high.

    The IMF stated that stronger policy efforts and reforms are critical to reduce the current elevated uncertainty that weighs on the outlook, strengthen Pakistan’s resilience, and obtain financing support from official partners and the markets that is vital for Pakistan’s sustainable development.

    Pakistan lost $3 billion in the shape of low exports and low foreign remittances due to wrong government policies of the past four months, former Finance Minister Miftah Ismail said on Thursday. Miftah Ismail said Dar underestimated the IMF’s role which hurt Pakistan’s cause.

    The central bank reported on Thursday that its reserves depleted by $923 million

    to $3.7 billion as of January 20th. However, the sources said the reserves further dropped to $3.2 billion as of January 24th.

    Some of the measures that Pakistan will take are highly inflation and could cause rapid acceleration of inflation.

    Military to remain a holy cow

    Meanwhile, in order to meet another condition of the IMF, the FBR on Thursday unveiled the “Sharing of Declaration of Assets of Civil Servants Rules, 2022”.

    The rules will allow the commercial banks to seek the asset details of the civil servants before opening their bank accounts.

    However, the government has excluded the army officers from the purview of the asset declarations, which is discriminatory and highlights one of the reasons behind current economic mess in Pakistan where privileged classes are protected.

    The rules showed that the FBR will share a simplified or abridged version of declaration- based on the fields agreed with the State Bank declared by a civil servant in his electronic declaration filed with FBR. The bank shall obtain an express written consent from the civil servant of whom the bank intends to access information from FBR; and the bank shall obtain a certificate from the civil servant as per prescribed format annexed duly signed by the person declaring that he is a civil servant of BS-17 and above, with his complete name, designation, employee number and all other particulars that are prescribed in the format.

  • Lawyers bodies to move SJC against SC judge | The Express Tribune


    ISLAMABAD:

    Top lawyers’ bodies, including the Pakistan Bar Council (PBC), on Tuesday announced filing separate complaints of misconduct in the Supreme Judicial Council (SJC) against a Supreme Court judge after audio leaks emerged purportedly featuring conversation about the fixation of case before a particular bench or judge with former Punjab chief minister Pervaiz Elahi.

    The announcement was made by PBC Executive Committee Chairman Hasan Raza Pasha during a news conference which was also attended by the representatives of all superior bars, including provincial bar councils.

    Pasha said all bar councils were on the same page over the issue, adding that the complaint will be lodged next week.

    He also demanded of the government to withdraw the review appeal on the decision against the reference on Justice Qazi Faiz Isa, saying that it had \”malicious\” intent.

    Pasha said that they had urged the top court to investigate the audio leaks. However, he added, they decided to file the complaint as they did not get any response from the apex court.

    He said that the resolution for the protection of lawyers was also approved whereas a motion to amend the SJC rules was also endorsed during the meeting.

    The meeting also demanded that army officers and retired judges should not be offered any government post. It also urged to appoint senior judges in the Supreme Court.

    Audio leak

    Two separate audio clips were leaked on social media last week. In the first audio clip, a man believed to be Elahi can be heard telling “Joja sahab” that the SC judge should be appointed to hear the “Muhammad Khan case”.

    Meanwhile, superior bars have increased their pressure for initiating misconduct proceedings in the SJC against the judge.

    The Independent Lawyers Group representatives are taking a lead role on the issue. At one time, they were seen rescuing the same judge, when the SJC initiated misconduct proceeding against him on account of a judicial order.

    On the other hand, the Professional Lawyers Group is totally silent. Two members of the group, who attended all lawyers regularity bodies, have supported the decision regarding filing of complaint against the SC judge.

    Interestingly, both the lawyers groups strongly supported Justice Qazi Faez Isa, when the SJC initiated the proceeding of misconduct against him on the insistence of “powerful circles”.

    Lawyers are divided as to whether the SJC can oust a judge on the basis of leaked audios. Several senior lawyers think that the contents of leaked audios would not be enough to oust a judge. They believe that this is a tactic to put pressure on one section of the judges who are giving relief to the PTI for the last couple of years.

    Only the chief justice of Pakistan, being the SJC chairman, can initiate the misconduct proceeding against a judge.

    In case, the CJP initiates the misconduct proceeding against the SC judge, then the composition of incumbent SJC will be crucial. Justice Isa and Justice Sardar Tariq Masood are also members of the council. Similarly, the chief justices of the Sindh High Court and the Lahore High Court are also members of the SJC.

    It is also learnt that the SC\’s written order regarding the restoration of the CCPO Lahore has yet to be issued.

  • Balochistan tense after recovery of three bodies | The Express Tribune


    QUETTA:

    Tension gripped Balochistan on Tuesday after the Levies force discovered three bodies – a mother and her two sons – from a well in Barkhan district, triggering a strong protest by the local Marri tribesmen.

    The deceased were family members of a local tribesmen, Khan Muhammad Marri. The victims were identified as Giran Naz, wife of Khan Muhammad Marri and her two sons Mohammad Nawaz, in his 20s, and Abdul Qadir, in his teens.
    The police said that the bodies were recovered from a well in the Haji Kot area of the district on Monday night.

    They were initially taken to the Barkhan Civil Hospital and after completion of medico-legal formalities, handed over to their heirs.

    On Tuesday, hundreds of Marri tribesmen, carrying the tree bodies in two ambulances, had started a march from Barkhan to Quetta to stage a protest demonstration outside the Balochistan Assembly to get justice.

    Khan Muhammad Marri accused the provincial Communication and Works Minister Sardar Abdul Rehman Khetran of murdering his family members. He also said that the victims were tortured before they were killed.

    However, talking to various media outlets, Khetran denied the accusation and termed the allegations propaganda to tarnish his political reputation. Khetran said that the murders were a conspiracy against him.

    Talking to The Express Tribune, Balochistan police chief Abdul Khaliq Sheikh said that a fair and transparent investigation would be carried out into the incident. “No one will be spared. A fair investigation will be conducted,” he said.

    The inspector general of police said the government had directed to conduct a free and fair investigation into the incident. He added, “If the DPO (district police officer) is responsible, action will be taken against him also.”

    Meanwhile, Balochistan Chief Minister Mir Quddus Bizenjo ordered the formation of a joint investigation team (JIT). “The government has decided to conduct an impartial inquiry into the recovery of the bodies,” he said in a statement on Tuesday evening.

    Several lawmakers from Balochistan strongly condemned the tragic incident, demanding an investigation into the incident. “We want justice for the bereft family,” Sanaullah Baloch, a lawmaker from the Balochistan National Party-Mengal, said.

    “Deeply saddened to see such horrifying visuals of Khan Mohammad Marri’s two sons and wife,” Senator Sarfraz Bugti wrote in a tweet. “Khan Mohammad Marri has been running from pillar to post to get justice since the last many days. I firmly stand with him in this difficult time.”

    The Human Rights Commission of Pakistan (HRCP) said it was horrified by the discovery of three bullet-ridden bodies and the related alleged illegal detention. “These serious allegations must be investigated promptly,” the HRCP said in a tweet.

    Attack on Levies

    In a separate incident on Tuesday, two levies personnel were martyred when armed men opened fire on them in the Babari area of Mastung district.

    The attackers fled, while the bodies were shifted to the district headquarters hospital.
    In another incident, a man, who opened fire at the police in the Chaman district, was shot dead on the spot in retaliatory fire. Another attacker was also injured in the exchange of fire but he managed to escape. The police started an investigation into the incident.

  • PTI embraces Elahi, 10 ex-MPAs into party fold | The Express Tribune

    Former Punjab chief minister Pervaiz Elahi on Tuesday formally joined the Pakistan Tehreek-e-Insaf (PTI) along with 10 former provincial assembly members, in a move not unexpected to the keen watchers of the prevailing political scene in the province.

    Elahi’s announcement came after the Pakistan Muslim League-Quaid (PML-Q) President Chaudhry Shujaat Hussain sacked him as the party’s Punjab president and revoked his basic membership.

    Addressing a joint news conference along with PTI Senior Vice President Fawad Chaudhry, Elahi said he had always supported PTI Chairman and former prime minister Imran Khan during thick and thin.

    “We stood firmly with Imran Khan and will continue to stand with him in the future. We have complete faith in his leadership and we’re thankful to him that he has given us this opportunity,” Elahi said.

    The former MPAs, who joined the PTI included Hafiz Ammar Yasir, Shujaat Nawaz, Abdullah Warraich, Bao Rizwan, Sajid Bhatti, Ahsanul Haque, Mohammad Afzal, Basma Chaudhry and Khadija Umar Farooqui.

    Earlier, Elahi, along with the 10 former MPAs met with the PTI chairman at Zaman Park and discussed the political situation in the country.
    Moosa Elahi, Chaudhry Maqsood, Khurram Munawwar and Haji Umar Habib were also present in the meeting.

    Speaking on the occasion, Fawad said the party welcomed Elahi, Moonis Elahi, Hussain Elahi and their aides. “Now they have become part of the PTI and will start their journey under the leadership of Imran Khan for New Pakistan,” he said.

    Fawad underscored that Elahi had rendered sacrifices and remained steadfast with Imran. He added that the PTI chief offered Elahi to join the party because it would be a win-win arrangement for both sides.

    “Elahi and his supporters always stood with Imran Khan,” the senior PTI leader said.

    Fawad added that Elahi would also be given the post of president in the PTI and the senior leadership had already approved the decision.

    To a question, the former chief minister said that if anyone thought he switched parties because of some “signal”, then that was “good news” because he wished to “take everyone along”.

    Elahi, 77, became the chief minister of Punjab for a second time with the support of the PTI, after he sided with Imran just before the PTI chief’s removal from the office of the prime minister through a no-confidence motion.

    At that time, the PML-Q favoured the no-trust move. However, the PTI chief then nominated him for the post of the chief minister. He was elected to the post in July despite opposition from Chaudhry Shujaat.

    In January, Elahi dissolved the Punjab Assembly, calling for early elections in the province on the instructions of the PTI chairman. On Jan 15, Elahi had indicated at the possible merger of the PML-Q with the PTI.

    However, the next day, PML-Q president sent him a show-cause notice and suspended his membership of the party over the merger comments.

  • Economic stability will be restored soon: Ayesha | The Express Tribune


    ISLAMABAD:

    Minister of State for Finance Ayesha Ghaus Pasha has said that economic stability will be restored in the country very soon as Pakistan has taken all the necessary steps as per the request of the International Monetary Fund (IMF).

    “Pakistan has a strategy to get out of economic problems, so Pakistan should not default, and the people should not listen to the propaganda of bankruptcy,” Ayesha said while addressing the media here on Tuesday.

    The state minister said that Pakistan would fulfil all its international obligations and till now there was no obligation that Pakistan had not fulfilled.

    “Negotiations with the IMF are in final stages which will be completed in a positive manner,” she said, adding that parliament passed the mini-budget of Rs170 billion.

    The state minister said that the subsidies received by the rich class were being removed. “The tariff has been increased for those who use more electricity and gas while electricity and gas subsidy will be only for the poor sections.”

    She said that one of the reasons for Pakistan\’s economic problems was the international situation, but Pakistan had a strategy to get out of economic problems.

  • PTI seeks consultation on new NAB chief | The Express Tribune


    LAHORE/ISLAMABAD:

    PTI Senior Vice President Fawad Chaudhry has said that a new leader of the opposition in the National Assembly from his party should be notified before the selection of new chairman of the National Accountability Bureau (NAB).

    Fawad insisted that since the Lahore High Court (LHC) has suspended the notification of PTI lawmakers, the opposition leader in NA should be picked from the party.

    Thus, he demanded, a head of the anti-graft body should be appointed only after proper consultation with the opposition leader.

    The former federal minister noted that the current leader of the opposition, Raja Riaz – a disgruntled PTI legislator – lacked the credentials for the process as “everyone knows he was a turncoat”.

    If the NAB chief is appointed with the consultation of Riaz, it would be unacceptable, he added.

    He went on to stress that the PTI would approach the courts if a PTI parliamentarian was consulted on the matter and claimed that NAB Chairman Aftab Sultan resigned from his post due to “pressure to lodge fake cases” against the government’s opponents.

    He claimed that an organised campaign has been launched against the judges. “The PML-N has started a campaign against five judges involved in the Panama case,” he alleged and said that the Supreme Court of Pakistan should take notice of this.

    The PTI wants to strengthen the judicial system in the country, he added.

    He disclosed that the PTI has decided that when whenever the court calls them, they would appear before the courts. “I do not understand why the judges thought calling Imran to the court was necessary. However, out of respect for the judiciary, the former premier appeared for the hearing,” he added.

    However, he castigated the authorities for not making arrangements for the PTI chief’s visit to the LHC.

    “The high court made history on the occasion of PTI Chairman Imran Khan’s appearance before the bench. The people of Lahore showered their love [on Imran].”

    Commenting on PTI’s ‘jail bharo’ (volunteer arrest) movement, he said it kick off on Wednesday (today), adding it would be on peaceful protests.

    He expressed thanks to the government for imposing Section 144 (on the few roads of the city) and added that tomorrow thousands of people would stage a protest on Mall Road. “Our only demand is snap polls,” he added.

    On this occasion, PTI Senator Ejaz Chaudhry said the movement was the next political plan of the PTI, adding that about 200 leaders and workers would surrender themselves before the authority.

    “This movement was also a protest against inflation and the arrests would be made in other cities after Lahore,” he added.

    PTI writes to NA speaker

    On the other hand, in a related development, PTI wrote a letter to National Assembly Speaker Raja Pervaiz Ashraf seeking to regain the key position in the wake of the NAB head’s resignation.

    PTI Chief Whip in National Assembly Malik Aamir Dogar submitted the letter to the National Assembly Secretariat on the instruction of PTI Chairman Imran Khan.

    Citing the verdict of the LHC, the letter stated that the largest opposition party in the national legislature was PTI. Hence, the opposition leader must be from the same party.

    The letter added that according to the NAB law; the appointment of a new chairman also has to be carried out after consultation between the leader of the house and the leader of the opposition.

    Therefore, the replacement of NAB\’s former chairman Aftab Sultan must be finalised after consultation with the new opposition leader nominated by PTI.

  • SC questions customs operating within cities | The Express Tribune


    ISLAMABAD:

    The Supreme Court of Pakistan has questioned the legal authority of customs officials operating within the country, observing that their focus is on seizing personal belongings of citizens instead of preventing smuggling at border crossings.

    The three-judge bench, headed by Chief Justice Umar Ata Bandial, and comprising Justice Ayesha Malik, and Justice Athar Minallah, heard a case on customs authority, prompting inquiries into the lawfulness of officials\’ actions in city operations, market raids, and checkpoint setups.

    The court stressed the need for a clear understanding of customs officers’ powers and jurisdiction to prevent the illegal trade of goods, including smuggled dollars, wheat, and fertilizers to Afghanistan.

    Justice Ayesha noted that instead of stopping smuggling, the customs officials paid more attention to individual actions.

    She added that the attention of the customs officials was diverted towards apprehending the citizens\’ vehicles and other belongings, rather than where these items were smuggled from.

    She asked what law authorised the customs officials to conduct raids at markets and set up checkpoints.

    She continued that the main question was about the powers and jurisdiction of the customs officers.

    Justice Minallah asked the customs officials whether the smuggling law applicable to an item caught in the city.

    He added that the Customs officials were not responding to the court’s queries properly and they needed to be more prepared.

    Justice Ayesha observed that the Customs officials operated in the cities every day, far from the borders.

    CJP Bandial inquired whether the seizure of goods on the highway near Multan would be smuggling or a matter related to customs duty.

    “Is it correct for the customs authorities to stop citizens inside the city and ask for documents?” he asked.

    He recommended that the customs officials should facilitate the economy besides seizing smuggled goods.

    The court later adjourned the hearing for two weeks, giving time to the customs authorities to prepare for the case.

    It was revealed in a meeting held in December last year that the government had failed to stop the smuggling of the dollars to Afghanistan that was underway using orange crates and with the connivance of law enforcement agencies.

    It also emerged during the meeting that the Customs Act was not in conformity with the new limits set for outbound currency flow, hampering the registration of criminal cases against the smugglers.

    The participants of the huddle expressed their concerns over the smuggling of dollars, imported wheat and fertiliser to Afghanistan.

    Finance Minister Ishaq Dar emphasised the relevant authorities to devise a robust and proactive roadmap to curb the cross-border smuggling of various items in order to bring economic and financial stability to the country.
