  • IHC directs Imran to appear before banking court by Feb 28 | The Express Tribune

    The Islamabad High Court on Wednesday rejected the request of Pakistan Tehreek-e-Insaf (PTI) chief Imran Khan to attend via video link and instead directed him to appear in person before the banking court by February 28 in the prohibited funding case. The court extended its stay order against the verdict of the banking court on the interim bail of the former prime minister. Imran\’s lawyer had produced a fresh medical report and requested for a medical board, but the court said there was no need for it. Additional Attorney General Munawar Dogal said it was necessary for any petitioner to appear in person to get interim bail, and asked for Imran Khan to appear before the court by February 28. After this, the court ordered Imran Khan to appear before the concerned court by February 28, and stopped the banking court from taking any decision on his bail case until that time.     Pakistan Tehreek-e-Insaf (PTI) chief Imran Khan on Wednesday officially announced the beginning of the party\’s Jail Bharo Tehreek – a drive to court arrests in an effort to register its protest against the \”attack\” on fundamental rights and the economic \”meltdown\” brought on by the incumbent government.

    Taking to Twitter, the former premier elaborated upon two reasons behind the protest movement: \”One, it is a peaceful, non-violent protest against the attack on our constitutionally-guaranteed fundamental rights […] Two, it is against the economic meltdown brought on by cabal of crooks who have money laundered billions in looted wealth and gotten NROs for themselves while crushing the people, especially the poor and middle class, under the burden of spiralling inflation and rising unemployment.\”

    \”That is only possible if the state protects your fundamental rights, therefore, this Jail Bharo movement is a jihad [holy war]\” which he deemed synonymous with \”freedom\”.

    \”I believe the more of you that would participate, the sooner we will arrive at our objectives, that we will attain true freedom for our country,\” he added.

    Meanwhile, PTI stalwarts Shah Mahmood Qureshi and Asad Umar volunteered to court arrest in Lahore to formally begin the drive.

    Speaking to the media outside PTI Chairman Imran Khan’s residence in the provincial capital, senior vice president Fawad Chaudhry announced that the “historic movement” would commence from Lahore.

    Both senior party leaders and activists will court arrests to the authorities at Faisal Chowk on Mall Road, he said.

    Fawad maintained that during a meeting, the PTI leadership had decided that all senior party leaders and workers would court arrest to support the party\’s new drive.

    Senior party leaders Shah Mahmood Qureshi and Asad Umar have volunteered to court arrests on the first day of the movement, he added.

    However, the participants of the meeting insisted that the party should stick to the programme that had already been decided.

    Meanwhile, party sources indicated that PTI leaders, former Punjab governor Omar Sarfraz Cheema, Waleed Iqbal and former Punjab education minister Dr Murad Raas would also present themselves for arrest on the first day of the movement.

    Lahore under Section 144

    On the other hand, the caretaker provincial government has already imposed Section 144 for a week in three areas of the provincial capital, including Mall Road.

    As per an official notification issued by the additional chief secretary last Monday, the government had outlawed all gatherings, protests and processions from Mian Mir Bridge to Istanbul Chowk on Mall Road, including its immediate vicinity, the Civil Secretariat and its adjoining roads and Main Boulevard Gulberg.

    The notification stated that Section 144 prohibited all kinds of assemblies, gatherings, rallies, processions, demonstrations, protests, and other similar activities in these areas.

    It added that rallies and protests posed significant security risks as Mall Road and main boulevard Gulberg Lahore were historically significant and contained business centres as well as highly sensitive historical installations.

    “Moreover, Pakistan Super League would shift in Lahore from February 26, where a large number of spectators are likely to visit Qaddafi Stadium, via Main Boulevard Gulberg. Hence, the government imposes Section 144 in Lahore,” the notification said.

    On the other hand, the ruling coalition appears to be at odds with each other about what the government\’s next move should be.

    According to political sources, the Pakistan Peoples Party (PPP) and the Awami National Party (ANP) have advised the government not to arrest the PTI workers.

    A faction of the Pakistan Muslim League-Nawaz is also against making arrests. However, the party’s central chief organiser is an active supporter of the arrests.

  • PHC seeks govt reply to plea against Imran over murder plot claim

    PESHAWAR: The Peshawar High Court on Tuesday gave the interior secretary a fortnight’s time to respond to a petition against former prime minister and PTI chairman Imran Khan over his claim that a plot has been hatched to kill him through two hired shooters from South Waziristan tribal district.

    A bench consisting of Justice Ishtiaq Ibrahim and Justice Syed Arshad Ali also directed law-enforcement agencies not to “harass” the residents of Waziristan region on the basis of the statement of Mr Imran.

    It issued the order after preliminary hearing into a petition of advocate Sajjad Ahmad Mehsud, who sought orders for the Pakistan Tehreek-i-Insaf chief to disclose the source of his information.

    The petitioner also requested the court to act against Mr Imran if the former PM failed to share the source of that plot information or his information was found to be false.

    He also sought the court’s orders for explanation by the Pakistan Electronic Media Regulatory Authority over the coverage of that assassination claim by TV channels without verification.

    The petitioner claimed that the assertion about the hiring of two shooters from South Waziristan tribal district had caused chaos in the area besides giving a bad name to the local population.

    Also directs law-enforcers not to harass residents of Waziristan

    He prayed the high court to declare illegal the act of Mr Imran as well as that of other respondents, including government functionaries, to ignore the fundamental rights of the people of that area by issuing and allowing the issuance of that statement.

    Mr Mehsud sought an interim relief requesting the court to stop the government and other respondents from taking any “adverse action” against inhabitants of South Waziristan on the basis of that claim of assassination plot until the final disposal of the petition.

    The petitioner contended that military operations were successfully carried out in the erstwhile Federally Administered Tribal Areas, especially in South Waziristan district, against militants on different occasions leading to the martyrdom of scores of personnel of security forces, local inhabitants and other people.

    He said that the people of the area were displaced before being brought back in phases after their proper clearance and that, too, after their areas were declared free from all miscreants.

    The petitioner added that restrictions were imposed on the keeping of arms and ammunition and maintaining links with militants.

    He said that while chairing a meeting of his party at his residence in Lahore’s Zaman Park area a few days ago, Mr Imran alleged that a plot had been hatched to kill him and “two professional assassins from South Waziristan” tribal district had been hired for the purpose.

    The petitioner said that that controversial statement had led to the negative profiling of the residents of Waziristan region.

    He contended that the inhabitants of South Waziristan region had not been treated in accordance with the law and that such misstatement on part of the former prime minister to link them with terrorism had greatly damaged their image.

    The petitioner said that the people of South Waziristan district were victims of terrorist activities and they had already seen great devastation, so the impugned statement would make people see them with suspicion in future.

    قومی احتساب بیورو (نیب) نے توشہ خانہ کیس میں سابق وزیراعظم اور پاکستان تحریک انصاف (پی ٹی آئی) کے چیئرمین عمران خان اور ان کی اہلیہ بشریٰ بی بی کو منگل کو 9 مارچ کو طلب کرلیا۔ آج نیوز اطلاع دی

    کال اپ نوٹس، مورخہ 17 فروری کو، اینٹی گرافٹ واچ ڈاگ کے چیئرمین آفتاب سلطان کے استعفیٰ دینے کے چند گھنٹوں بعد، مبینہ طور پر \”ٹوئ دی لائن\” سے انکار کرنے کے بعد منظر عام پر آیا۔

    نیب نے اپنے نوٹس میں کہا، \”مجاز اتھارٹی نے NAO، 1999 کی دفعات کے تحت ملزمان کی جانب سے مبینہ طور پر کیے گئے جرم کا نوٹس لیا ہے۔\”

    نیب انکوائری میں انکشاف ہوا ہے کہ عمران نے بطور وزیر اعظم اپنے دور حکومت میں مختلف غیر ملکی شخصیات کی جانب سے دیے گئے کچھ سرکاری تحائف اپنے پاس رکھے تھے۔

    توشہ خانہ ریفرنس: الیکشن کمیشن نے پی ٹی آئی کے سربراہ عمران خان کو نااہل قرار دے دیا۔

    تحائف میں شامل ہیں:

    – رولیکس کلائی گھڑی نمبر M228206-0036, 43.6470

    – رولیکس کلائی گھڑی نمبر M126331-0014, 2G367435

    – رولیکس کلائی گھڑی نمبر M1I6700LS001,(999927K8) اویسٹر ایس

    – ایک آئی فون جو قطر کے آرمی چیف نے 14/11/2018 کو پیش کیا۔

    – رولیکس کلائی گھڑی نمبر یاٹ ماسٹر، اویسٹر، سیریل نمبر 068A7072۔ ماڈل 116680

    — رولیکس کلائی گھڑی (No.E67574V3)، کف لنکس کا جوڑا، ایک انگوٹھی، اور پینٹ اور کوٹ کا بغیر سلے ہوئے کپڑا سعودی عرب کے ولی عہد کی مورخہ 18/09/2020۔

    – گراف گفٹ سیٹ جس میں ایک گراف کلائی گھڑی ماسٹر گراف اسپیشل ایڈیشن مکہ ٹائم پیس، ایک 18K گولڈ اور ڈائمنڈ گراف قلم، انگوٹھی، اور مکہ کی مائیکرو پینٹنگ کے ساتھ کفلنک کا جوڑا۔

    انسداد بدعنوانی کے نگراں ادارے نے عمران اور ان کی اہلیہ کو 9 مارچ کو نیب راولپنڈی کے دفتر میں مشترکہ تحقیقاتی ٹیم کے سامنے پیش ہونے اور اس حوالے سے اپنا بیان ریکارڈ کرنے کو کہا۔

    گزشتہ سال نومبر میں نیب نے سابق وزیراعظم، ان کی اہلیہ اور کابینہ کے دیگر ارکان کو ملنے والے تحائف کی اصل قیمت ظاہر نہ کرنے کا نوٹس لیا تھا۔

    فرد جرم موخر کر دی گئی۔

    ایڈیشنل سیشن جج ظفر اقبال نے سماعت کی جس میں سابق وزیراعظم کی قانونی ٹیم نے طبی بنیادوں پر ذاتی حاضری سے استثنیٰ کی درخواست کی۔

    وکیل نے کہا کہ 28 فروری کو پی ٹی آئی چیئرمین کے کچھ ایکسرے کرائے جانے ہیں۔

    جج نے کہا کہ اسے ہر بار استثنیٰ دیا جا رہا ہے۔

    گزشتہ سماعت کے دوران عدالت نے عمران پر فرد جرم موخر کرتے ہوئے انہیں 21 فروری (آج) کو طلب کیا تھا۔

    کے مطابق ایکسپریس نیوزنیب اسلام آباد کی جانب سے سابق وزیراعظم کو نوٹس بھجوایا گیا اور عمران کی بنی گالہ اور چک شہزاد اسلام آباد میں رہائش گاہوں پر بھیجا گیا۔

    نوٹس میں احتساب کے نگراں ادارے نے عمران پر الزام لگایا کہ انہوں نے بطور وزیر اعظم اپنے دور میں ملنے والے تحائف فروخت کیے، جن میں چار رولیکس گھڑیاں، 2018 میں قطر کی مسلح افواج کی جانب سے دیا گیا ایک آئی فون اور دیگر تحائف شامل ہیں جو انہوں نے مبینہ طور پر خلاف قانون فروخت کیے تھے۔

    اس سے قبل آج ایک ضلعی اور سیشن عدالت نے پی ٹی آئی کے سربراہ کی سزا موخر کر دی۔ فرد جرم توش خانہ ریفرنس میں 28 فروری تک طبی بنیادوں پر حاضری سے استثنیٰ کی منظوری دے دی۔

    ایڈیشنل سیشن جج ظفر اقبال نے الیکشن کمیشن آف پاکستان (ای سی پی) کی جانب سے توشہ خانہ ریفرنس میں سابق وزیراعظم کے خلاف فوجداری کارروائی کے کیس کی سماعت کی۔

    پی ٹی آئی سربراہ کی جانب سے عمران کے وکیل بیرسٹر گوہر عدالت میں پیش ہوئے اور ان کی حاضری سے استثنیٰ کی درخواست دائر کی۔

    کارروائی شروع ہوتے ہی عدالت نے استفسار کیا کہ ایک اور استثنیٰ کی درخواست کیوں ہے، عمران کو عدالت میں پیش ہونے کی ہدایت کی۔

    وکیل نے کہا کہ معزول وزیر اعظم کا ایکسرے 28 فروری کو کرایا جائے گا اور وہ اس کے بعد ہی عدالت میں پیش ہو سکتے ہیں۔

    جسٹس اقبال نے ریمارکس دیئے کہ لگتا نہیں ٹرائل ہو گا۔ جب گوہر نے وضاحت کی کہ عمران لاہور ہائی کورٹ (LHC) پہنچ چکے ہیں کل \”بڑی مشکل سے\”، جج نے کہا کہ \”اسے اسی مشکل سے یہاں آنا پڑے گا\”۔
