The Peshawar High Court has asked the Khyber Pakhtunkhwa government to provide details about people in military custody for their involvement in violent protests on May 9. The court set a hearing for Dec 14 after a petition was filed on behalf of six people in military custody, asking for them to be moved to civilian prisons. The government has filed an appeal against a Supreme Court ruling, which declared trial of civilians by military courts unconstitutional. The lawyer argued that the suspects should not be in military custody after the court’s ruling and that it goes against the Constitution and the law. The respondents in the petition are the federal government, defense and interior secretaries, and Khyber Pakhtunkhwa government. The lawyer also mentioned that the suspects were initially arrested in connection with an FIR, and then handed over to military authorities for trial. This goes against the court’s ruling and the suspects should be transferred to the relevant civil prisons.
