The Supreme Court will hear a case today challenging the mass deportation of Afghan nationals. A new petition was filed seeking Pakistani citizenship for Afghan children born in Pakistan. The petition was filed by former senator Farhatullah Babar and LUMS faculty members in the interest of underprivileged Afghan people living in Pakistan. The petition also seeks to reverse the government’s decision to deport Afghans and to establish a proper procedure for asylum applications. It argues that regardless of their status, refugees should be treated according to the Constitution and international law. The petition states that there are about 1.7 million undocumented Afghan refugees in Pakistan, with 600,000 arriving after the Taliban takeover in August 2021. Around 300,000 of them have tried to register as refugees with the UNHCR, but have not been allowed. The Supreme Court is asked to declare the mass deportation as unconstitutional and to protect the rights of Afghan refugees in Pakistan.
