Retired Justice Arshad Hussain Shah has been appointed as the caretaker chief minister of Khyber Pakhtunkhwa after the ex-CM Azam Khan passed away. The appointment was made after Mahmood Khan consulted with opposition leader Akram Khan Durrani. The KP governor approved the appointment. There is a debate on how a new caretaker chief executive would be appointed as there are no explicit constitutional provisions for such a scenario. Some legal minds believe that the mechanisms for the initial appointment of a caretaker chief minister can be adopted for the new appointment, while others disagree. The situation is further complicated as the former CM Mahmood Khan, who was a consultee in the initial appointment, left the ruling party. There is a constitutional crisis after the death of the caretaker CM and his cabinet dissolved. The burden will now be on courts to interpret the constitutional provisions. Caretaker Information Minister Murtaza Solangi stated that after the caretaker CM’s demise, the governor, chief secretary, and the provincial government will perform their duties accordingly.
