Kmart has been fined $1.3 million for breaking spam laws over 200,000 times. The Australian Communications and Media Authority (ACMA) had warned Kmart multiple times about their actions, but the retailer continued to send marketing emails to people who had already unsubscribed. An ACMA investigation revealed that the breaches occurred due to technology, system, and procedural failures. ACMA had previously notified Kmart about potential issues with its marketing compliance before launching the investigation. The breaches of the spam laws took place from July 2022 to May 2023.
