A 15-member bench started hearing challenges to the Supreme Court (Practice and Procedure) Act 2023. This is the first time that the proceedings are being live streamed. The Attorney General for Pakistan submitted the government’s response, asking the court to reject the petitions against the Act. The Chief Justice of Pakistan, Justice Isa, stated that arguments in the case will start afresh because a new bench has been formed. The arguments began with Advocate Khawaja Tariq Rahim presenting his case. Justice Qazi Faez Isa, who recently became the 29th Chief Justice of Pakistan, formed the full court to hear the petitions against the SC practice law. This 15-member full court bench is currently hearing the case. The SC (Practice and Procedure) Act, 2023 was previously suspended on August 11 by an eight-judge bench, and the act was declared null and void. The Supreme Court (Review of Judgements and Orders) Bill 2023 was passed by the National Assembly to give the right of appeal under Article 184 of the constitution. The bill aims to ensure transparent proceedings within the apex court and protect the right to appeal. It also outlines the constitution of benches and the process for considering cases invoking the court’s original jurisdiction.
