The Pakistan Bar Council (PBC) Vice Chairman, Haroonur Rashid, has expressed hope that the new Chief Justice of Pakistan (CJP), Qazi Faez Isa, will resolve pending complaints against judges and decide constitutional matters according to the law and court traditions. The PBC also hopes that benches will be formed transparently during Justice Isa’s tenure as CJP. Mr. Rashid criticized the outgoing CJP for his decisions, which he believes will not be remembered positively in history. He also criticized the outgoing CJP for not consulting the PBC on important matters and ignoring Bar Associations. Furthermore, he criticized the Supreme Court for setting a different election date for the Punjab Assembly compared to the Khyber Pakhtunkhwa Assembly, which he believes is a decision that undermines the dignity of the top judiciary. Mr. Rashid hopes that the new CJP will restore the dignity of the apex court and review wrongly interpreted constitutional matters. He also mentioned the lawyers’ community’s expectation for the implementation of the Supreme Court (Practice and Procedure) Act 2023. Mr. Rashid alleged that the outgoing CJP violated the Code of Conduct for judges and expressed hope that the new CJP would initiate proceedings against judges who ruled against the appointment of the audio commission. He also raised concerns about the appointment of government officers as the Supreme Court’s registrar. Mr. Rashid expressed regret over the formation of benches and the picking and choosing of particular cases, which he believes made the Judicial Commission of Pakistan redundant.
