Pakistan’s Registrar Supreme Court has issued a circular regarding a judgement on the suo moto power of the Chief Justice of Pakistan, claiming it violated the rules that were laid out by a five-judge larger bench. The Registrar, Ishrat Ali, revealed the judgement, which was issued by Justice Qazi Faez Isa and Justice Aminuddin Khan on March 29, travelled beyond the lis before the Court and therefore ‘violated the rule’. Meanwhile, the judgment said that all cases, including those of the various Supreme Court benches, that were being heard under Article 184 (3) of the Constitution be halted until amendments are made in the Supreme Court Rules 1980 regarding the discretionary powers of the CJP. Article 184(3) of the Constitution gives the Supreme Court the extraordinary power to assume jurisdiction over any “question of public importance with reference to the enforcement of any … Fundamental Rights”.
