    Treason Case Against Musharraf: News and Discussions

    Govt to write CJP for forming a commission to initiate proceedings against Musahrraf.

    ISLAMABAD (AFP) - Pakistan announced Sunday it would put former military ruler General Pervez Musharraf on trial for treason, punishable by death or life imprisonment, for imposing emergency rule in 2007.

    "Following the judgement of the Supreme Court and a report submitted by an inquiry committee, it has been decided to start proceedings against General Pervez Musharraf (for treason) under Article 6 of the Constitution," Interior Minister Chaudhry Nisar Ali Khan told a press conference televised live.
    "It is happening for the first time in the history of Pakistan and the decision has been taken in the national interest," Khan said.

    The minister said the country s Chief Justice would Monday receive a letter from the government requesting the setting-up of a tribunal of three high court judges to start proceedings against Musharraf.
    The government would also announce a special prosecutor on Monday.

    Musharraf is already facing four major criminal cases dating back to his 1999-2008 rule, including one related to the assassination of former prime minister Benazir Bhutto in 2007.

    Last week he asked a court to let him leave the country to visit his sick mother in Dubai. The court was expected to rule on the application on Monday.

    There have been rumours in recent months that a deal would be reached for Musharraf to leave Pakistan without going through with his trials.

    Khan said that three thrice-elected Prime Minister Nawaz Sharif s government had come to power five months ago and it had never demonstrated any "revengeful" gesture towards General Musharraf.
    Musharraf overthrew the Sharif government in a bloodless military coup in October 1999, but a year later the Supreme Court validated the take over.

    In November 2007 Musharraf imposed emergency rule, suspending the constitution and parliament and sacking top judges who declared his actions unconstitutional and illegal.

    Musharraf technically became a free man this month when an Islamabad district court granted him bail over a deadly raid on a radical mosque in the capital in 2007.

    His return to Pakistan in March was far from the triumphant occasion he had hoped for.
    He was barred from contesting the general election, which was won convincingly by Prime Minister Nawaz Sharif -- the man he ousted from power in 1999 -- and was hit with a series of criminal cases dating back to his rule.

    Apart from the mosque raid, he faces charges over Bhutto s murder at an election rally in 2007, the death of a Baluch rebel leader in 2006 and the detention of judges in 2007.

    He was put under house arrest in April, an unprecedented move against a former army chief in a country where the military holds huge power.

    The timing is pretty convenient to say the least. Absolutely nothing to do with Rawalpindi, I'm sure, definitely not deflecting attention :P

    Musharraf’s spokesman criticises decision

    SLAMABAD: A spokesman for former military ruler retired Gen Pervez Musharraf has termed the government’s decision to initiate his treason trial under Article 6 “a vicious attempt to undermine the Pakistani military”.

    “We not only forcefully reject these charges, but also view them as a vicious attempt to undermine the Pakistani military. It is also a botched attempt by the government to temporarily take the focus away from existential threats faced by Pakistan,” said Dr Raza Bokhari, international spokesman and North American point of contact for Gen Musharraf, in a statement.

    “We view with grave suspicion the timing of the announcement by the Taliban sympathetic Nawaz government to initiate treason proceedings against former president Musharraf,” he said. Moreover, he said, it was “unfortunate” that Prime Minister Nawaz Sharif was “obsessed by politics of personal vendetta” and was “criminalising the lawful acts of the Musharraf government”.

    He said Gen Musharraf had declared a state of emergency on Nov 3, 2007, and held in abeyance certain sections of the constitution in exercise of powers vested in him by Article 232 of the Constitution.

    “He took this much needed action to reform an activist segment of the judiciary and augment security operations against extremists and terrorists who were wreaking havoc in Pakistan.”

    The spokesman further said it was important to note that the former president had acted after unanimous advice of the then prime minister, governors of all the four provinces, chairman of the Joint Chiefs of Staff Committee, chiefs of the armed forces, vice-chief of the army staff and the corps commanders of the Pakistan Army.

    “It is also extremely important to remember that former president Musharraf also lifted the state of emergency on Dec 15, 2007, and fully restored the constitution,” he added.

    the real issue at hand is that forex reserves are 4 billion, probably lowest in 10-14 years. Economy economy economy this was what mr nawaz sharif said about his priority !

    Interior Ministry pushes Musharraf treason trial forward

    ISLAMABAD: The Interior Ministry has sent a letter to the Law Ministry regarding the former president General (retd) Pervez Musharraf’s treason case, Express News reported on Monday.
    In the letter, the ministry states that Musharraf had violated the constitution by imposing emergency rule in the country in November 2007.
    According to the letter, a trial needs to take place as soon as possible with a ‘special court’ hearing the case. The prosecutor for the case needs to selected immediately as well, the letter further stated.
    This letter will be sent to the Supreme Court by the Law Ministry.
    The case can only proceed further after the judges are decided by the Supreme Court.
    SC seeks names of the judges to hear treason case
    Chief Justice of Pakistan Iftikhar Muhammad Chaudhry has asked the chief justices of all five high courts of the country to nominate one judge from each high court by tomorrow, who would be a part of a ‘special court’ that would hear the treason case against the former president, Express News reported.
    CJP Chaudhry has forwarded Law ministry’s letter regarding the former president General (retd) Pervez Musharraf’s treason case to all the five high courts.
    The Chief Justice will select three judges, one each from three high courts to hear the case.
    Removal from ECL
    The Sindh High Court (SHC) also adjourned the hearing of the petition regarding removing Musharraf’s name from the Exit Control List (ECL) to November 22.
    On November 12, SHC had issued a notice to the federal law officer, chief provincial law officer and prosecutor general Sindh, asking them to submit their comments on Musharraf’s application to have his name removed from ECL.
    A division bench of the SHC, headed by Justice Sajjad Ali Shah, was seized with the hearing of the application filed by the former army chief. Musharraf wanted the court to modify its earlier order, which had restrained him from leaving the country without permission of trial courts.
    Treason case
    The government will formally request the Supreme Court today to constitute a ‘special court’ to try former military ruler Pervez Musharraf for high treason.
    “Following the judgment of the Supreme Court and a report submitted by an inquiry committee, it has been decided to start proceedings against Gen (retd) Pervez Musharraf under Article 6 of the Constitution,” Interior Minister Chaudhry Nisar Ali Khan had told a news conference in the federal capital on November 17.
    “It is happening for the first time in the history of Pakistan. This case is very sensitive and important and the decision has been taken in the national interest,” he had added.
    The move comes after Musharraf was granted bail in other criminal cases against him, including the assassination of former premier Benazir Bhutto, slaying of Baloch nationalist leader Nawab Akbar Bugti and Lal Masjid siege.
    The All Pakistan Muslim League (APML), the political party of Pervez Musharraf, had said that the former military ruler will face the charges in the court and prove his innocence. On the other hand, opposition parties had termed the government’s decision to invoke Article 6 against Musharraf a “tactic to divert public attention from sectarian unrest” in Rawalpindi .

    Note A "Special court" is to be set up - Why? The CJP has aksed all 5 high courts to submit names of prospective judges and in doing has made sure that none of these high courts cannot escape the backlash.

    the PML-N has taken the advice of the AKP in Turkiye, they have they imagine set the Turkish military in it's proper place bu trying and imprisoning the highest ranking generals -- but it seems as if this trial is to be set in very confined framework, for instance the funding provided to the Sharif brothers and the mullahs against BB, is not treason, negotiating and not holfing accountable the killers of 50000 Pakistanis is not treason/

    Lets see how this pays out, I hope the trial proceeds as the CJP and PML-N want it to - Karma is a bitch

    Don't think he would get the support. He had a chance to wipe him out last time but he allowed him to leave. He should have killed them all off. Remember what Shareef has done. It was worse than treason if you look at history but we forget when they get into power

    And it also sets a precedence - ISI bosses will also be tried for creating the Islamist unity party for defeating BB and funding the Sharif brothers -- some think, that they will somehow escape accountability under article 6, but with the setting up of a special court a precedence has been set - may the brothers enjoy it - but you can be sure no Islamist will ever have to face such a court nor such a charge
